TomTom partners with Fiat and Toyota to deliver in-dash navigation, traffic (update: Mercedes, too)

TomTom partners with Fiat and Toyota

If you're a GPS company, one way to keep the smartphone feature creep at bay is to strike deals with car manufacturers, and bake your wares into their vehicles. TomTom has done particularly good securing these partnerships and Fiat is just the latest company to sign on the dotted line. Its navigation software will be built into the Uconnect Radio Nav systems found in the 500L series from the Italian car marker. It will eventually roll out to other vehicles and Fiat brands, but there was no timeline given. TomTom also inked a deal with Toyota's European arm to put TomTom HD Traffic in any vehicle packing a Touch&GO in-dash device. For more, check out the PR after the break.

Update: TomTom announced that it'll also be doling out traffic info to select Mercedes-Benz vehicles in 12 European countries via HD Traffic, which will be baked into the luxury car-makers COMAND nav system.

(AP) ? The Arkansas Senate voted Tuesday to override Gov. Mike Beebe's veto of legislation that would ban most abortions from the 12th week of pregnancy onward and give the state the most restrictive abortion laws in the country.

There was no debate before the 20-14 vote. Beebe told legislators in his letter explaining his veto Monday that he believes the proposal is unconstitutional and conflicts with the 1973 U.S. Supreme Court decision in Roe v. Wade. But the bill's sponsor said after Tuesday's vote that he thinks the Democratic governor is wrong.

"That's not valid. The U.S. Constitution says nothing whatsoever about abortion. This is governed by case law," said Sen. Jason Rapert, a Republican from Conway.

The House sponsor of Rapert's bill said she'll ask that chamber to vote on an override Wednesday. Only a simple majority is needed in each chamber to trump a governor's veto. If the House overrides Beebe's veto, the 12-week ban would take effect later this year.

Last week, the Republican-controlled Legislature overrode Beebe's veto of a separate bill outlawing most abortions beginning in the 20th week of pregnancy. That bill, which immediately became law, is based on the disputed notion that a fetus can feel pain by then and thus, deserves protection from abortion.

So-called fetal pain laws enacted in other states are being challenged in court, and abortion rights proponents have said they would sue to block Arkansas' 12-week ban if it's approved. The 12-week standard is based on when a fetus' heartbeat can typically be detected through an abdominal ultrasound.

"Just like we said last time, the Legislature has the final say," Beebe spokesman Matt DeCample said after Tuesday's vote. "So we'll see what the House decides to do.

"We don't purport to guess what either house of the Legislature will do on any issue, so we just, at this point, (there's) nothing for us to do but watch and see what happens. The governor's already stated his position pretty strongly," DeCample said.

All 14 Senate Democrats voted against the override, including five who supported the ban last week.

"I still agree with it. It's the thing to do," said Sen. Bobby Pierce, D-Sheridan. He said he voted against the override as a courtesy to the governor.

Beebe contends that both measures are unconstitutional and contradict Roe v. Wade, which legalized abortion until a fetus can viably survive outside the womb, generally around 22 to 24 weeks. Beebe says the state would have to waste money defending the bans in court, and noted that Arkansas paid nearly $148,000 to attorneys for plaintiffs who successfully challenged a 1997 late-term abortion ban.

The 12-week ban would prohibit abortions when a heartbeat is detected using an abdominal ultrasound. It includes exemptions for rape, incest, the life of the mother and highly lethal fetal disorders. The 20-week prohibition includes all of the same exemptions except for fetal disorders.

The measure is among several abortion restrictions lawmakers have backed since Republicans won control of the House and Senate in the November election. Republicans hold 21 of the 35 Senate seats, and 51 of the 100 seats in the House.

Beebe has signed into law one of those measures ? a prohibition on most abortion coverage by insurers participating in the exchange created under the federal health care overhaul.

If ultimately approved, the 12-week restriction wouldn't take effect until 90 days after the House and Senate adjourn. Lawmakers aren't expected to wrap up this year's session until later this month or April.

The American Civil Liberties Union of Arkansas has vowed to sue if the state enacts the 12-week ban ? and the group said it was considering legal action over the 20-week restriction as well. Planned Parenthood has called the 12-week ban the nation's most restrictive anti-abortion law.

"I think we're one step closer to the most intrusive abortion law in the country and it sets Arkansas back decades in public perception in the minds of other people: potential employers, businesses and people who might want to move here," said Rita Sklar, the ACLU of Arkansas' executive director.

The original version of Rapert's bill would have banned abortions as early as six weeks into a pregnancy, but he changed the measure after facing resistance from some lawmakers worried that it would require a vaginal probe.

Women who have abortions would not face prosecution under Rapert's bill, but doctors who perform abortions in violation of the 12-week ban could have their medical licenses revoked.

Forex Analysis: GBP/USD Consolidates after Reaching 1.5000 ...

Forex News | Written By James Chen |

2013-03-06-GBPUSD

GBP/USD (daily chart) as of March 6, 2013 has settled just above major support around the 1.5000 handle. This occurs after price dropped down to hit this target late last week. Since the downside price objective was hit, price has consolidated just above it in preparation for the next significant move. The two-month downtrend (starting at the very beginning of the year), has clearly been steep and dramatic, having broken down below multiple previous support levels. The low just below 1.5000 that was hit on Friday established a 31-month low for the pair.

Despite this extreme low and the current consolidation above key 1.5000 support, the bearish trend has shown little indication of relenting. With major resistance up around the previously broken 1.5250 level, any significant breakdown below 1.5000 would confirm a downtrend continuation with a further downside objective around the 1.4800 support level.

FirstRand faces slower growth as credit boom dims

JOHANNESBURG (Reuters) - South Africa's second biggest bank, FirstRand, said it is scaling back loans and setting aside more money for bad debts, signs that the consumer credit bonanza in Africa's top economy may be coming to an end.

South African banks have been aggressively pushing lucrative loans to shoppers, sparking concerns that debt levels, especially among lower-income borrowers, are unsustainable.

FirstRand reported a 29 percent surge in first-half profit on Tuesday, as earnings from lending and fees grew by double digit numbers. Shares rose 3 percent on the results, but the bank cautioned that loan growth would likely slow to single digits in the second half.

Other banks in South Africa could start to see a similar squeeze, said Tracy Brodziak, a banking analyst at Old Mutual Equities.

"For advances growth, the trends will be pretty similar. I would expect to have a slow down in unsecured lending," she said.

"We are not expecting on the consumer side real disposable income to grow significantly. That will put pressure on taking out further loans and advances, so we expect it to moderate."

CREDIT TIGHTENING

South African bank customers were hit hard by a recession that cut more than one million jobs during the credit crisis. Households are carrying debt equal to 76 percent of their disposable incomes and unemployment remains stuck at around 25 percent.

But lenders have been relatively unscathed due to tight regulation by the Reserve Bank.

While borrowing has helped fuel consumer spending, fattening profits for both banks and discount retailers, the economy has struggled to post convincing growth.

South Africa last week cut its 2013 growth forecast to 2.7 percent, from the 3.0 percent previously seen.

FirstRand Chief Executive Sizwe Nxasana said the bank was setting aside over 500 million rand in additional provisions, on top of the 800 million it set aside in June 2012.

"That's in anticipation of a tightening credit environment and a slowing environment where customers are going to find it a bit more difficult despite the fact that interest rates went down even further," he told Reuters.

"Customers' indebtedness is still a big issue."

Nxasana said the bank tightened up credit scoring on unsecured lending in the mass market last year, and is now becoming more vigilant with the middle-income market.

FirstRand's vehicle and asset finance unit, WesBank, wrote new business worth 39.2 billion rand, a 19 percent rise from a year ago, driven chiefly by motor and unsecured credit books.

However, in another sign that consumer spending may be weakening, data on Monday showed that new auto sales increased just 1.6 percent year-on-year in February, and an auto industry body warned sales will remain sluggish this year.

FirstRand said diluted headline earnings - the main measure of profit in South Africa and exclude certain one-time items - totaled 131.1 cents per share in the six months to end-December, from 101.5 cents a year earlier.

High margin loans from its retail unit, First National Bank (FNB), and WesBank boosted net interest income before bad debts by 18 percent to 12.38 billion rand.

Smaller rival Capitec Bank, one of the pioneers in South Africa's consumer lending market, said on Tuesday it expects its full-year profit to rise by as much as 36 percent.

Shares of FirstRand were 3.4 percent higher at 31.86 rand by 1425 GMT, outpacing 1.7 percent rise in Johannesburg's benchmark Top-40 index.

Nikon Coolpix S3500 ships this month with 20MP CCD, lens-shift VR for $139

Nikon Coolpix S3500 ships this month with 20MP CCD, lensshift VR for $139

We don't tend to get excited about any CCD sensor-equipped point-and-shoot nowadays, but Nikon's Coolpix S3500 has at least one feature that we don't often see on a camera in this price range: lens-shift optical image stabilization, or Vibration Reduction (VR). Otherwise, this point-and-shoot's specifications are par for the course, and include a 20.1-megapixel CCD sensor, a 7x, f/3.4-6.4 optical zoom lens and a rather-weak QVGA (320 x 240-pixel) LCD. It can shoot 720p video, too, though we wouldn't expect industry-leading IQ. At $139, the S3500 is priced right for casual photographers, and its orange, pink, purple, red and silver color schemes should appease most digicam-hungry tweens. Hop past the break for some talking points from Nikon HQ.

NEW YORK (AP) ? Jurors are seeing evidence that a New York City police officer surfed the Web for subjects like "eat her for dinner."

An FBI agent presented the evidence Monday at the cannibalism-plot trial of Officer Gilberto Valle (VAL'-ee).

Prosecutors allege the 28-year-old Valle wanted to abduct and eat women. The defense says it was all fantasy.

The government says Valle used his computer to look up "how to tie up a girl," ''human meet recipes" and other topics.

Earlier Monday, the judge barred prosecutors from showing gruesome photos of mutilated women. He said there was no proof Valle ever looked at the images.

Heidi Klum joins 'America's Got Talent' as judge

Gus Ruelas / REUTERS

By Randee Dawn, TODAY contributor

There's a new judge in town on "America's Got Talent," and she's just the right fit for the job: NBC confirmed Monday that "Project Runway" host Heidi Klum would be joining the talent competition series as a fourth judge, the first time the panel has been expanded to include that number.

"Heidi has an amazing career across multiple media platforms, and has built a brand that is a force in the entertainment business," said Paul Telegdy, president of alternative and late night programming for NBC in a press release.

"She has achieved superstardom while balancing being a businesswoman and hard-working mom, bringing a huge amount of experience,?discernment and taste to the panel," Telegdy said. "As we look to develop an act that will get the world's attention, we and the contestants will benefit from Heidi's international sensibility and understanding of what works in today's global entertainment industry."

Klum joins other judges Howard Stern, Howie Mandel and Mel B for what will be the series' eighth season. She's already had years of reality show experience, having parlayed her supermodel career into "Project Runway," where she's hosted and evaluated designers for 11 seasons.

Klum seemed excited to expand her schedule with one more TV show, noting in the release, "America's got some serious 'Talent!' I'm really excited to join the panel of 'AGT' to see it all -- from the ridiculous to the fantastic. I love the surprise element of the show and not knowing what we'll see next and who will wow us. I'm also looking forward to spending time with my fellow judges!"

The Greatest Freedom For Your Phone ? Root Your Android

When first hearing about root-android.org, I was definitely skeptical. The whole thing just sounded too good to be true, but after going with an impulsive buy, I was blown away by the greatness that was behind the curtain. While most people will try to read through this hype, those that are willing to take a stab at ultimate phone freedom will rejoice with the features that are presented here. You?ll find that there are several different pieces to the puzzle that will illuminate your sense for technology. Consider just a few of the best parts about rooting your system and creating the freedom to do anything you want on your terms.

Why Go Stock?

When you purchase a vehicle, most often people upgrade certain components. Whether it?s for racing or visual aesthetics, few leave the vehicle untouched at all. It?s with that in mind that many are starting to realize that they have great power with their phones. If you want to serious change things up, you?ll have to look into this option. By rooting you are opening up the components to full blast. Or rather, you?re turning up the amps to 11! All the roms, programs and different things that used to be forbidden to you will now be easily added to your line up of applications.

There?s absolutely no reason why you should have a stock gadget, because when you least expect it, it will turn into a brick and collect dust like many other gadgets that you may have purchased in the past.

Better Functionality

The built in keyboard on your device, the tethering, the blue tooth

and everything else that you will want to use on your phone comes with standard programming and functionality. It?s basic, and it doesn?t use the core processor that you have built into the smartphone that you have purchased. Look online at the specifications of even the entry-level Android devices, and you?ll note that the core processors and ram can match the speeds of your laptop in many ways. Even with all that power, there are moments when you slow down, speeds dissipate and you are left wondering what is going wrong.

That?s not the case here; I found that after installing and running root-android.org, my phone was a new thing. It reacted like a ram upgrade to my computer system, as everything was fast. Multi-touch, apps, and even emulators were running at top speeds and if that wasn?t enough, I found that the wi-fi connection was much better and didn?t have any hiccups with my web browsing or streaming of videos.

Test The Waters

The biggest thing that I would note about this option is that I finally have control. I hate the notion of being shackled by phone services, and companies that want to make sure that my phone craps out in 2 years so that I have to buy another one. That?s not the case now; I have opened up the phone, and am running it like a small business laptop wherever I go, and without incident thus far. Getting to root-android.org and checking out the features really was the best thing I did in regards to tech today.

UK's 'naked rambler' arrested for nudity, again

(AP) ? A British man who has spent most of the past decade naked ? and in jail ? was back behind bars Friday after defying an order to cover up.

Stephen Gough, known as the "Naked Rambler," was arrested Thursday as he left a court in Southampton, southern England, wearing only boots, socks and a knapsack.

A judge had just imposed an order that he must "wear sufficient clothing in public to at least cover his genitalia and buttocks."

The 54-year-old former Royal Marine appeared at the same court Friday, and was ordered detained until a hearing on March 25.

Since 2003 Gough has completed two naked walks the length of Britain, with frequent interruptions for arrests, court appearances and jail time.

Prosecution lawyer Roger Trencher said Friday that Gough "has caused much offense nationwide and he has used a considerable amount of police time in England, Wales and Scotland."

Gough has said he believes nudity is a human right. Defense lawyer Jeffrey Norie-Mille told the court that Gough "believes it is his right not to wear clothes and go about his normal activities in that state of undress."

There is no law in Britain against public nudity. However, there are laws against indecent exposure or behavior likely to cause "harassment, alarm or distress."

Gough has served multiple sentences for appearing nude in public places including courts and an airplane.

He could face up to five years in jail for breaching the no-nudity command, known as an Anti-Social Behavior Order.

(AP) ? Gridlocked once more, President Barack Obama and Republican congressional leaders refused to budge in their budget standoff Friday as $85 billion in across-the-board spending cuts bore down on individual Americans and the nation's still-recovering economy. "None of this is necessary," said the president after a sterile White House meeting that portended a long standoff.

Even before Obama formally ordered the cuts required by midnight, their impact was felt thousands of miles away. In Seattle, the King County Housing Authority announced it had stopped issuing housing vouchers under a federal program that benefits "elderly or disabled households, veterans, and families with children."

The president met with top lawmakers for less than an hour at the White House, then sought repeatedly to fix the blame on Republicans for the broad spending reductions and any damage that they inflict. "They've allowed these cuts to happen because they refuse to budge on closing a single wasteful loophole to help reduce the deficit," he said, renewing his demand for a comprehensive deficit-cutting deal that includes higher taxes.

Republicans said they wanted deficit cuts, too, but not tax increases. "The president got his tax hikes on Jan. 1," House Speaker John Boehner told reporters, a reference to a $600 billion increase on higher wage earners that cleared Congress on the first day of the year. Now, he said after the meeting, it is time take on "the spending problem here in Washington."

Senate Republican leader Mitch McConnell of Kentucky was equally emphatic. " I will not be part of any back-room deal, and I will absolutely not agree to increase taxes," he vowed in a written statement.

At the same time they clashed, Obama and Republicans appeared determined to contain their disagreement.

Boehner said the House will pass legislation next week to extend routine funding for government agencies beyond the current March 27 expiration. "I'm hopeful that we won't have to deal with the threat of a government shutdown while we're dealing with the sequester at the same time," he said, referring to the new cuts by their Washington-speak name.

Obama said he, too, wanted to keep the two issues separate.

White House officials declined to say precisely when the president would formally order the cuts. Under the law, he had until midnight. Barring a quick deal in the next week or so to call them off, the impact eventually is likely to be felt in all reaches of the country.

The Pentagon will absorb half of the $85 billion required to be sliced between now and the end of the budget year on Sept 30, exposing civilian workers to furloughs and defense contractors to possible cancellations. Said Defense Secretary Chuck Hagel, only a few days on the job: "We will continue to ensure America's security" despite the challenge posed by an "unnecessary budget crisis."

The administration also has warned of long lines at airports as security personnel are furloughed, of teacher layoffs in some classrooms and adverse impacts on maintenance at the nation's parks.

The announcement by the housing agency in Seattle was an early indication of what is likely to hit as the cuts take effect. It said it was taking the action "to cope with the impending reduction in federal funding," adding that it normally issues 45 to 50 vouchers per month.

After days of dire warnings by administration officials, the president told reporters the effects of the cuts would be felt only gradually.

"The longer these cuts remain in place, the greater the damage to our economy ? a slow grind that will intensify with each passing day," he said. Much of the budget savings will come through unpaid furloughs for government workers, and those won't begin taking effect until next month.

Obama declined to say if he bore any of the responsibility for the coming cuts, and expressed bemusement at any suggestion he had the ability to force Republicans to agree with him.

"I am not a dictator. I'm the president," he said. "So, ultimately, if Mitch McConnell or John Boehner say we need to go to catch a plane, I can't have Secret Service block the doorway, right?" He also declared he couldn't perform a "Jedi mind meld" to sway opponents, mixing Star Wars and Star Trek as he reached for a science fiction metaphor.

Neither the president nor Republicans claimed to like what was about to happen. Obama called the cuts "dumb," and GOP lawmakers have long said they were his idea in the first place.

Ironically, they derive from a budget dispute they were supposed to help resolve back in the fall of 2011. At the time, a congressional Supercommittee was charged with identifying at least $1.2 trillion in deficit savings over a decade as part of an attempt to avoid a first-ever government default. The president and Republicans agreed to create a fallback of that much in across-the-board cuts, designed to be so unpalatable that it would virtually assure the panel struck a deal.

The Supercommittee dissolved in disagreement, though. And while Obama and Republicans agreed to a two-month delay last January, there was no bipartisan negotiation in recent days to prevent the first installment of the cuts from taking effect.

It isn't clear how long they will last.

Of particular concern to lawmakers in both parties is a lack of flexibility in the allocation of cuts due to take effect over the next few months. That problem will ease beginning with the new budget year on Oct. 1, when Congress and the White House will be able to negotiate changes in the way the reductions are made.

For his part, Obama suggested he was content to leave them in place until Republicans change their minds about raising taxes by closing loopholes.

"If Congress comes to its senses a week from now, a month from now, three months from now, then there's a lot of open running room there for us to grow our economy much more quickly and to advance the agenda of the American people dramatically," he said.

"So this is a temporary stop on what I believe is the long-term, outstanding prospect for American growth and greatness."

But Republicans say they are on solid political ground. At a retreat in January in Williamsburg, Va., GOP House members reversed course and decided to approve a debt limit increase without demanding cuts. They also agreed not to provoke a government shutdown, another traditional pressure point, as leverage to force Obama and Democrats to accept savings in benefit programs like Medicare, Medicaid and Social Security.

Obama has said repeatedly he's willing to include benefit programs in deficit-cutting legislation ? as long as more tax revenue is part of the deal.

"I am prepared to do hard things and to push my Democratic friends to do hard things," he said at the White House on Friday.

Republicans speak dismissively of such pledges, saying that in earlier negotiations, the president has never been willing to close a deal with the type of changes he often says he will accept.

Rev. Dr. Cindi Love: Cedarville Baptists Send VP and President Packing

I want to give a big shout-out to The New York Times for its persistent and intriguing coverage of Christian colleges and universities in the United States that are sifting and sorting their theological and ministry positions on homosexuality and gender expression. And I want to thank Times writer Mark Oppenheimer for specifically mentioning that my beloved Soulforce was again blamed by the conservative Cedarville University trustees for raising the question of whether a person can be Christian and gay on their campus. As I mentioned in a previous blog post, those of us at Soulforce feel like we have done a good day's work when people have to think about and talk about what it means to be gay and Christian.

Cedarville's Vice President for Student Life, Dr. Carl Ruby, was a gracious host when we visited the campus in 2007. Unlike some school leaders who arrange to have our Riders arrested for trespassing when they try to speak about the Bible and homosexuality, Dr. Ruby allowed us on campus, organized a series of chapel talks about homosexuality and encouraged students to welcome us with love. Though Dr. Ruby persists in his belief that the Bible condemns homosexual acts, he thought that our visit was an opportunity to teach Cedarville students how to gracefully engage those with whom they may disagree.

It is Cedarville's loss that Dr. Ruby resigned under pressure last month. He was like a refiner's fire on the campus, helping "faculty, students and trustees at Cedarville try to figure out what kind of Christians they are." Oppenheimer writes, "Are they sectarian or broad-minded? Fundamentalist or open? Republicans, or independent of political parties? Those who want a less fundamentalist, more open Cedarville believe that Dr. Ruby is a martyr to their cause."

Cedarville University, founded in 1887, was affiliated with the General Association of Regular Baptist Churches, an insular fundamentalist organization that firmly legislated conduct of all kinds. Lately, though, liberalism has encroached upon their safe space. For example, some kinds of dancing are now allowed on campus. Some professors did not vote for Romney and told their students why not. And some resident theologians suggested that the creation story might not be literally true. But as Oppenheimer explains, "The departures of William Brown, the president, whose resignation is effective June 30, and of Dr. Ruby, are widely viewed as strengthening the hands of the most conservative trustees, fearful of a more open Cedarville."

Oppenheimer quotes the Rev. Chris Williamson, who resigned from the Cedarville board of trustees last month, as saying, "[The trustees] were threatened by Carl's approach not to theology but to ministry, in terms of his ministry to people struggling with gender identification, how he ministers to people on the margins." Dr. Ruby sounds just like Jesus to me, the radical includer.

For now, the conservative faction is having its way with Cedarville -- but not for long, I predict. Love trumps ignorance and exclusion. Dr. Ruby was a true educator and a compassionate Christian. He influenced students and faculty alike. He told them that he wanted them to be sincere engagers with the culture, just as Jesus instructed his disciples. If Cedarville wants to persist in its mission as a Christian institution, it will have to sort out what it means to really be Christian in the world. What does it mean to be trustworthy in the name of Christ?

I am grateful that Dr. Ruby was trustworthy in the ways that really matter. Rather than driving young people out of church and convincing them that God doesn't love them, he created a safe haven where they could be themselves and sort out their own beliefs without exclusion.

"In the end we all have to trust someone with our spirits and inner thoughts. Caution is wise is making this decision. A bad haircut grows out, but a broken spirit is slow to mend."

WASHINGTON (AP) ? The Associated Press has learned that the Homeland Security Department released more than 2,000 illegal immigrants facing deportation from immigration jails in recent weeks because of looming budget cuts. It also planned to release 3,000 more during March.

The newly disclosed figures, cited in internal government budget documents reviewed by the AP, are significantly higher than what the Obama administration acknowledged this week as a "few hundred" illegal immigrants who were released under the budget-savings process.

The budget documents show that Immigrations and Customs Enforcement released roughly 1,000 illegal immigrants from its jails around the U.S. each week since at least Feb. 15. The agency's field offices have reported more than 2,000 released before intense criticism this week led to a temporary shutdown of the plan.

Toxic oceans may have delayed spread of complex life

Feb. 28, 2013 ? A new model suggests that inhospitable hydrodgen-sulphide rich waters could have delayed the spread of complex life forms in ancient oceans. The research, published online this week in the journal Nature Communications, considers the composition of the oceans 550-700 million years ago and shows that oxygen-poor toxic conditions, which may have delayed the establishment of complex life, were controlled by the biological availability of nitrogen.

In contrast to modern oceans, data from ancient rocks indicates that the deep oceans of the early Earth contained little oxygen, and flipped between an iron-rich state and a toxic hydrogen-sulphide-rich state. The latter toxic sulphidic state is caused by bacteria that survive in low oxygen and low nitrate conditions. The study shows how bacteria using nitrate in their metabolism would have displaced the less energetically efficient bacteria that produce sulphide -- meaning that the presence of nitrate in the oceans prevented build-up of the toxic sulphidic state.

The model, developed by researchers at the University of Exeter in collaboration with Plymouth Marine Laboratory, University of Leeds, UCL (University College London) and the University of Southern Denmark, reveals the sensitivity of the early oceans to the global nitrogen cycle. It shows how the availability of nitrate, and feedbacks within the global nitrogen cycle, would have controlled the shifting of the oceans between the two oxygen-free states -- potentially restricting the spread of early complex life.

Dr Richard Boyle from the University of Exeter said: "Data from the modern ocean suggests that even in an oxygen-poor ocean, this apparent global-scale interchange between sulphidic and non-sulphidic conditions is difficult to achieve. We've shown here how feedbacks arising from the fact that life uses nitrate as both a nutrient, and in respiration, controlled the interchange between two ocean states. For as long as sulphidic conditions remained frequent, Earth's oceans were inhospitable towards complex life."

Today, an abundance of nitrate, in the context of an oxygenated ocean, prevents a reversion to the inhospitable environment that inhibited early life. Determining how Earth's oceans have established long-term stability helps us to understand how modern oceans interact with life and also sheds light on the sensitivity of oceans to changes in composition.

David McCann, Sunrise Cop, Accused Of 'Nooner Sex' While On Duty Loses Arbitration

SUNRISE -- A married cop accused of having sex on duty and working an outside job without permission got a 200-hour suspension after supervisors determined the claims were true.

Saying he was wrongly defamed, David McCann took his case to arbitration -- and lost.

The suspension -- 160 hours for on-duty sex with former mistress Melissa Kingfield and 40 hours for breaking the rules on outside employment -- will cost him $7,874.

The arbitrator's decision, released to the Sun Sentinel on Thursday, cannot be appealed.

McCann's accuser was a credible witness and McCann was not, arbitrator Mark Lurie wrote in his 31-page ruling.

McCann, 42, and Kingfield, 31, both declined to comment.

McCann told supervisors he and his ex-lover had sex only when he was off duty.

But Kingfield said they had sex while he was on the clock -- and she had the diary to prove it.

At the department's request, Kingfield created a detailed spreadsheet to prove McCann had sex with her while in uniform.

Kingfield noted the days and hours they were together, including whether they had "nooner sex" or "quality sex" with hugging and cuddling.

The couple started a two-year relationship after they met at a crime watch meeting in 2009. When the romance fizzled in the summer of 2011, she turned her journal over to Internal Affairs.

McCann had sex with Kingfield more than 90 times, including 34 times while on duty, based on her journal and the Internal Affairs finding.

The department cross-referenced dates and times in the spreadsheet with McCann's time card to show he was on duty when the two had sex.

"Nooner sex," says the log's first entry in May 2009.

"Hugging -- No sex still on a break/He says next time we're together we'll have a baby," says the last entry on June 8, 2011.

Soon after, McCann changed his phone number and stopped calling Kingfield.

"I basically totally cut her off," he told Internal Affairs. "I changed my phone number. I blocked all her emails."

He told supervisors Kingfield was a scorned woman intent on revenge.

"I felt conned, manipulated, used," Kingfield said in a previous interview with the Sun Sentinel.

She told Internal Affairs: "I was dinner break booty call."

An anonymous letter delivered to the department in April 2011 triggered a separate inquiry into whether McCann had a full-time job with Fidelity Information Services. Sunrise prohibits employees from working more than 30 hours a week at an outside job.

The department confirmed that McCann earned $94,000 working 40 hours a week at Fidelity.

In February 2012, Police Chief John Brooks ordered McCann to quit the job within two weeks.

But McCann held onto his outside job after promising to work less than 30 hours a week, a department official said.

Groupon fires founder, CEO Andrew Mason

Groupon, the struggling online daily deals pioneer, announced Thursday that it has ousted CEO Andrew Mason.

Executive Chairman Eric Lefkofsky and Vice Chairman Ted Leonsis were appointed to the newly created ?Office of the Chief Executive? until a replacement is found.

The announcement was made after the market closed Thursday. Groupon shares shot up to $4.90 in after-hours trade, from a close of $4.53 on the Nasdaq.

In a cheeky email to employees, Mason wrote, "After four and a half intense and wonderful years as CEO of Groupon, I've decided that I'd like to spend more time with my family. Just kidding -- I was fired today. If you're wondering why ... you haven't been paying attention."

(Mason tweeted the email from his account. Read the full text below.)

The announcement came one day after Groupon announced a disappointing fourth quarter, prompting its stock to slide 24 percent. The fourth quarter net loss attributable to common stockholders was $81.1 million.

"On behalf of the entire Groupon Board, I want to thank Andrew for his leadership, his creativity and his deep loyalty to Groupon. As a founder, Andrew helped invent the daily deals space, leading Groupon to become one of the fastest growing companies in history," Lefkofsky said.

Rumors that Mason, 33, wasn't long for this post have been buzzing for some time as the company has struggled with growth and its stock has fallen below $5.

The company plans to hire a recruiting firm for the CEO search, a spokesman said.

The Groupon board met on Thursday and decided to replace Mason. No Groupon board members will be considered as CEO candidates, according to a person familiar with the board's deliberations.

Newly hired chief operating officer Kal Raman -- brought onboard to turn around the international operations -- is a possible candidate. However, the company is likely to favor an outside candidate who has e-commerce and global experience, said the person, who is familiar with Groupon's strategic thinking.

Arvind Bhatia, managing director at Sterne Agee, said after the dismal earnings that he still has a "buy" rating on Groupon stock.

Mason's email:

(This is for Groupon employees, but I'm posting it publicly since it will leak anyway)

People of Groupon,

After four and a half intense and wonderful years as CEO of Groupon, I've decided that I'd like to spend more time with my family. Just kidding - I was fired today. If you're wondering why ... you haven't been paying attention. From controversial metrics in our S1 to our material weakness to two quarters of missing our own expectations and a stock price that's hovering around one quarter of our listing price, the events of the last year and a half speak for themselves. As CEO, I am accountable.

You are doing amazing things at Groupon, and you deserve the outside world to give you a second chance. I'm getting in the way of that. A fresh CEO earns you that chance. The board is aligned behind the strategy we've shared over the last few months, and I've never seen you working together more effectively as a global company - it's time to give Groupon a relief valve from the public noise.

For those who are concerned about me, please don't be - I love Groupon, and I'm terribly proud of what we've created. I'm OK with having failed at this part of the journey. If Groupon was Battletoads, it would be like I made it all the way to the Terra Tubes without dying on my first ever play through. I am so lucky to have had the opportunity to take the company this far with all of you. I'll now take some time to decompress (FYI I'm looking for a good fat camp to lose my Groupon 40, if anyone has a suggestion), and then maybe I'll figure out how to channel this experience into something productive.

If there's one piece of wisdom that this simple pilgrim would like to impart upon you: have the courage to start with the customer. My biggest regrets are the moments that I let a lack of data override my intuition on what's best for our customers. This leadership change gives you some breathing room to break bad habits and deliver sustainable customer happiness - don't waste the opportunity!

I will miss you terribly.

Love,

Andrew
