David McCann, Sunrise Cop, Accused Of 'Nooner Sex' While On Duty Loses Arbitration

SUNRISE -- A married cop accused of having sex on duty and working an outside job without permission got a 200-hour suspension after supervisors determined the claims were true.

Saying he was wrongly defamed, David McCann took his case to arbitration -- and lost.

The suspension -- 160 hours for on-duty sex with former mistress Melissa Kingfield and 40 hours for breaking the rules on outside employment -- will cost him $7,874.

The arbitrator's decision, released to the Sun Sentinel on Thursday, cannot be appealed.

McCann's accuser was a credible witness and McCann was not, arbitrator Mark Lurie wrote in his 31-page ruling.

McCann, 42, and Kingfield, 31, both declined to comment.

McCann told supervisors he and his ex-lover had sex only when he was off duty.

But Kingfield said they had sex while he was on the clock -- and she had the diary to prove it.

At the department's request, Kingfield created a detailed spreadsheet to prove McCann had sex with her while in uniform.

Kingfield noted the days and hours they were together, including whether they had "nooner sex" or "quality sex" with hugging and cuddling.

The couple started a two-year relationship after they met at a crime watch meeting in 2009. When the romance fizzled in the summer of 2011, she turned her journal over to Internal Affairs.

McCann had sex with Kingfield more than 90 times, including 34 times while on duty, based on her journal and the Internal Affairs finding.

The department cross-referenced dates and times in the spreadsheet with McCann's time card to show he was on duty when the two had sex.

"Nooner sex," says the log's first entry in May 2009.

"Hugging -- No sex still on a break/He says next time we're together we'll have a baby," says the last entry on June 8, 2011.

Soon after, McCann changed his phone number and stopped calling Kingfield.

"I basically totally cut her off," he told Internal Affairs. "I changed my phone number. I blocked all her emails."

He told supervisors Kingfield was a scorned woman intent on revenge.

"I felt conned, manipulated, used," Kingfield said in a previous interview with the Sun Sentinel.

She told Internal Affairs: "I was dinner break booty call."

An anonymous letter delivered to the department in April 2011 triggered a separate inquiry into whether McCann had a full-time job with Fidelity Information Services. Sunrise prohibits employees from working more than 30 hours a week at an outside job.

The department confirmed that McCann earned $94,000 working 40 hours a week at Fidelity.

In February 2012, Police Chief John Brooks ordered McCann to quit the job within two weeks.

But McCann held onto his outside job after promising to work less than 30 hours a week, a department official said.
